§ 21.40.060. Nonconforming structures.

  • Any structure, which existed prior to the adoption of this chapter but does not meet the provisions of this chapter, shall be allowed to continue subject to the following conditions:

    A.

    No alterations may be made which increase the nonconformity;

    B.

    Any nonconforming building which has been destroyed or damaged by fire, explosion, act of God, or by a public enemy to the extent of sixty percent or more of its assessed valuation, shall thereafter conform to the provisions of this ordinance. Where more than forty percent of the assessed value of the building remains after such damage, such structure may be restored to the same nonconforming use as existed before such damage.
