§ 20.60.210. Approval—Authority—Certificate issued when.

  • A.

    The planning director or commission shall approve, modify, or disapprove the final plat of subdivision or dedication within 60 calendar days after the date of acceptance of the final plat and shall transmit to the surveyor, with a copy to the subdivider, a letter of final review indicating additions and revisions required prior to final borough approval and borough signature. The planning director or commission shall not approve a final plat which does not meet the requirements of this title or deviates in any significant way from the preliminary plat as approved.

    B.

    If not acted upon within 60 calendar days from the date of acceptance, the plat shall be deemed to have been approved and a certificate to that effect shall be issued by the commission on demand; provided, however, that the applicant for plat approval may consent to the extension of such period.

    C.

    Within one year of final plat approval by the planning director or the planning commission, the applicant shall present the original plat for signature of either the planning director or mayor. Failure to adhere to the time limits of this section shall void the final approval of the plat.

    D.

    When signed by either the mayor or planning director, the original plat shall be recorded with the appropriate district recorder within ten business days by the director. The planning director may authorize the surveyor who prepared the plat to record the plat.
